Amazon responds to woman's product liability suit

HOUSTON – Amazon, Inc. recently provided a formal response to a Texas woman’s product liability lawsuit in relation to a generic Apple TV remote control that was sold by the company’s Web site.

The 10-page original answer, which was filed on Aug. 8, counters allegations raised by Morgan Gartner by asserting Amazon did not sell the remote to the plaintiff.

As previously reported by The Southeast Texas Record, Gartner sued the online shopping giant in Houston federal court in June, claiming her one-year-old daughter ate a button battery from the device in question.

Gartner says the toddler suffered severe tissue damage to her esophagus.

Amazon further denies that it designed, manufactured, or sold the remote, but admits that co-defendant Hu Xi Jie sold the product on its marketplace.

Clifford L. Harrison of the law firm Munsch Hardt Kopf & Harr, P.C. in Houston is representing the company.
