HOUSTON – Five Houston residents allege their Sugar Land employer failed to pay them for overtime work.

Eduardo Bonilla, Alma Nelly Ruiz, Alberto Baires, Maryory Argueta and Maria De Los Angeles Sanchez filed a complaint on Aug. 20 in the Houston Division of the Southern District of Texas against Super El Toro Inc. and Riyazali A. Maknojia alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiffs allege that they regularly worked at the defendants' Mexican taqueria and market for more than 40 hours per workweek and were not paid the appropriate rate for overtime work.

The plaintiffs hold Super El Toro Inc. and Maknojia responsible because the defendants allegedly failed to pay overtime compensation for all hours worked in excess of 40 per week at a rate of time-and-one-half of their regular rate of pay.

The plaintiffs request a trial by jury and seek unpaid overtime wages, liquidated damages, with interest, attorney's fees, costs and expenses and such other and further relief as may be allowed by law. They are represented by Mark Siurek of Warren & Siurek LLP in Houston.
