Former Universal American employee files suit over age discrimination allegations

HOUSTON – A Harris County woman alleges her age and disability were factors in her termination by her employer.

Trisha S. Dixon filed a complaint on Aug. 20 in the Houston Division of the Southern District of Texas against Universal American, Caremark Ulysses Holding Corp., and WellCare Health Plans Inc. alleging wrongful termination, age discrimination and retaliation, and disability discrimination.

According to the complaint, the plaintiff was employed by Universal from June 2015 to February 2017. The suit states the plaintiff has hearing loss and an anxiety disorder and that when a new director was appointed in July 2015, the plaintiff observed that the director "treated older employees in a hostile and harassing manner."

The plaintiff alleges she reported the director's conduct in March 2016 and was retaliated against after making her complaints and eventually terminated.

The plaintiff holds Universal American, Caremark Ulysses Holding Corp., and WellCare Health Plans Inc. responsible because the defendants allegedly discriminated against her on the basis of his age and disability, retaliated against and harassed her for her complaints of discrimination and terminated her without explanation.

The plaintiff requests a trial by jury and seeks all damages, with interest, costs, attorney's fees and all other relief to which she is entitled. She is represented by Daniel R. Dutko of Hanszen Laporte LLP in Houston.
