Mi Taza Mexican Restaurant employee alleges she is owed unpaid overtime

SHERMAN – A Denton woman alleges she is not paid the appropriate rate for overtime work by her restaurant employer.

Sandra Garcia filed a complaint on Aug. 20 in the Sherman District of the Eastern District of Texas against BGV Restaurants LLC, doing business as Mi Taza Mexican Restaurant, alleging that the employer violated the Fair Labor Standards Act.

According to the complaint, the plaintiff works as a dishwasher, cook and busser at defendant’s restaurant in Denton and did not receive overtime compensation for all extra hours she worked over 40 hours per week. The suit states she has worked for the defendant since 2011.

The plaintiff holds BGV Restaurants LLC responsible because the defendant allegedly willfully failed to pay overtime compensation at a rate of one-and one-half times her regular hourly rate for all hours worked in excess of 40 hours in a workweek.

The plaintiff requests a trial by jury and seeks unpaid wages and compensation due, liquidated damages, plus interest, attorneys’ fees and costs and any other relief to which she may be entitled. She is represented by Jenny DeFrancisco of Lemberg Law LLC in Wilton, Connecticut.
