Woman alleges co-owner has not accounted for proceeds of La Marque property

GALVESTON – A Galveston woman is seeking to sell a property co-owned with a Mississippi man.

Heather Saracco filed a petition for partition of real estate and accounting for rents and waste on Aug. 21 in the Galveston County District Court against James W. Allen.

According to the complaint, the parties are co-owners who jointly own, in fee simple, the real property at 2115 Scott St., La Marque. The plaintiff alleges that the defendant has excluded her from the use of the property and has rented it to third parties without accounting for the proceeds.

The plaintiff requests that the court appoint an appraiser to establish the value of the property and proceed with a sale to divide the proceeds.

The plaintiff seeks an order for defendant to provide an accounting of all income from the property, appointment of an appraiser and receiver to take possession of and manage the property and proceed with sale and to divide such proceeds. She is represented by Ramzey Zein-Eldin of Ramzey Zein-Eldin & Associates in Galveston.
