Minor alleges negligence of Burlington Coat Factory of Texas caused injuries

GALVESTON – A minor and an adult are seeking damages from a retailer over allegations its negligence caused injuries to the minor.

Tenesha Tuton, individually and as next friend of Dion'aya Groom, a minor, filed a complaint on Aug. 21 in the Galveston County District Court against Burlington Coat Factory of Texas LLC alleging negligence.

According to the complaint, the plaintiffs allege that on Oct. 7, 2016, Groom was injured at defendant's store premises due to a dangerous condition caused by the defendant's negligence. Groom alleges she suffered personal injuries resulting in pain and suffering, mental anguish and medical care expenses as a result. 

The plaintiffs seek monetary relief of less than $100,000 and such other and further relief to which they are justly entitled. They are represented by Darrell S. Apffel, D. Blake Apffel of Apffel Legal PLLC in Galveston.
