GALVESTON – A La Marque man is alleged to have changed the titles of two recreational vehicles to his name instead of a partnership without notice.
Kimberly Maldonado, doing business as Ez RV Rental & Detailing Services, filed a complaint on Aug. 22 in the Galveston County District Court against Esquiel-Montemayor alleging breach of fiduciary duty, civil theft and breach of contract.
According to the complaint, the plaintiff alleges that on Sept. 14, 2017, the parties entered into a partnership agreement and purchased two recreational vehicles for a base of operation. The plaintiff alleges that the defendant changed the titles of the vehicles to his name only without notice and absconded with them.
The plaintiff holds Esquiel-Montemayor responsible because the defendant allegedly unlawfully appropriated, secured or stole the partnership’s property.
The plaintiff seeks actual damages, interest, attorney fees, costs and such other and further relief to which she may be entitled. She is represented by Douglas T. Godinich of The Law Office Douglas T. Godinich in Galveston.
