Employee alleges Covestro discriminated against him by terminated long-term disability benefits

HOUSTON – A Harris County man alleges his employer discriminated against him when it terminated his employment and benefits.

Kristopher D. Nelson filed a complaint on Aug. 21 in the Houston Division of the Southern District of Texas against Covestro LLC alleging that the polymer manufacturer violated the Employee Retirement Income Security Act and the Americans with Disabilities Act.

According to the complaint, the plaintiff alleges that he has been on long-term disability since 2010 after previously working for the defendant from 1998 to 2009. The suit states he received a letter in October 2017 that informed him his disability benefits would end Jan. 1.

Since then, he alleges he has been unable to afford to fill his prescriptions and had to obtain alternative, less-effective medications. 

The plaintiff holds Covestro LLC responsible because the defendant allegedly discriminated against him when it terminated his benefits and employment because of his disability.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages, reinstatement of all employment benefits, plus interest, attorney’s fees, costs and such other and further relief that he may be justly entitled.
