Power Management Controls alleges 5Nickles 'secretly siphoned' funds

GALVESTON – A League City company alleges an Ohio corporation and two individuals misappropriated funds.

Power Management Controls Inc. filed a complaint on Aug. 24 in the Galveston County District Court against the 5Nickles Inc., Andrew Lesnick and John Lesnick alleging breach of contract and other counts.

According to the complaint, the plaintiff alleges that the defendants "secretly siphoned" funds into a 5Nickles bank account. The plaintiff alleges it terminated its contract with the defendants after it discovered this, 5Nickles refused to sign a release in breach of their agreement.

The plaintiff holds 5Nickles Inc., Andrew Lesnick and John Lesnick responsible because the defendants allegedly refused to sign the release and cashed and kept the advanced-disbursement checks.

The plaintiff requests a trial by jury and seeks monetary relief of $100,000 or less and all other relief to which plaintiff may be entitled. It is represented by Nick Brown and Wesley G. Lotz of Fulkerson Lotz LLP in Houston.
