Former employee alleges Devil Pear failed to pay her for two weeks of employment

HOUSTON – A Houston commercial car wash is alleged to have failed to pay a former employee at a rate of time-and-half for overtime hours she worked.

Yolanda Martinez filed a complaint on Aug. 27 in the U.S. District Court for the Southern District of Texas against Devil Pear LLC alleging violation of the Fair Labor Standards Act and other counts.

According to the complaint, the plaintiff alleges that between Sept. 16, 2017, and March 27, 2018, she worked approximately 45 to 50 hours each week for the defendant without receiving appropriate overtime compensation. She alleges she was paid the same flat rate regardless of how many hours she worked.

The plaintiff holds Devil Pear LLC responsible because the defendant also allegedly failed to compensate her for the last two weeks of her employment and failed to pay proper overtime compensation throughout her employment.

The plaintiff requests a trial by jury and seeks unpaid minimum wage and overtime compensation, liquidated damages, attorneys’ fees, costs and expenses and such other just and appropriate remedies.
