Allegedly dubious sale of home causes woman to sue

HOUSTON – A Harris County woman alleges she was deceived in relation to the purchase of her home.

Madelaine Martinez filed a deceptive trade practices lawsuit against Green Acres MHP 92, L.P. and Darcia Ellis on Aug. 30 in the Harris County 125th District Court.

The 7-page complaint explains that Martinez purchased a 14 X 76 1983 Arlington manufactured home from the defendants for $5,500 in September 2017, as well as agreed to lease the space for a year and pay no more than $800 in taxes.

As part of the transaction, the original petition adds, the plaintiff was supposed to receive a statement of ownership about a month after the date of the sale.

Martinez, however, claims the document did not arrive and she “discovered that $1,453.18 was due for the manufactured home taxes. She further states that the respondents gave her a 6-month lease “when the bill of sale required 12 months.”

Martinez’s attempts to resolve the matter were unsuccessful, court papers say.

Consequently, the complainant seeks unspecified monetary damages and a jury trial.
