HOUSTON – A Missouri City consumer alleges a debt collector unlawfully "threatened" to have her arrested.
Eulena Narcisse filed a complaint on Aug. 30 in the Houston Division of the Southern District of Texas against Insolvent Resolutions Group LLC alleging that the debt collections company violated the Telephone Consumer Protection Act and the Texas Debt Collection Act.
According to the complaint, the plaintiff alleges that in early 2018, she began receiving calls to her cellular phone from defendant seeking to collect upon an alleged debt. She alleges prior to the calls, she had never received any correspondence regarding any debt.
The suit states the defendant told her that if she did not make a payment, then she would be arrested for committing fraud and that the defendant's representatives used foul and threatening language.
The plaintiff holds Insolvent Resolutions Group LLC responsible because the defendant allegedly had no lawful ability to make a threat of arresting her and attempted to coerce her into making a payment by making threats.
The plaintiff requests a trial by jury and seeks actual and punitive damages and such other and further relief as this court deems just and appropriate. She is represented by Nathan C. Volheim and Taxiarchis Hatzidimitriadis of Sulaiman Law Group LTD in Lombard, Illinois.
