JLG Equipment Services alleged to have failed to pay man for all hours worked

HOUSTON – A Porter man alleges his former employer failed to pay him for all the hours he recorded on his timesheet.

Jim Brock, individually and on behalf of all others similarly situated, filed a complaint on Sept. 5 in the Houston Division of the Southern District of Texas against JLG Equipment Services Inc. alleging that the Pennsylvania corporation violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that during his employment with the defendant, the company deducted one hour from his pay daily for a shift turnover. He alleges there was no designated time where he had no duties because of a shift turnover.

The plaintiff holds JLG Equipment Services Inc. responsible because the defendant allegedly failed to pay him the required rate of one-and-one-half times his regular rate of pay for hours worked in excess of 40 in a workweek.

The plaintiff requests a trial by jury and seeks unpaid regular and overtime compensation due, liquidated damages, attorneys’ fees costs and interest. He is represented by Hessam Parzivand of The Parzivand Law Firm PLLC in Stafford.
