HOUSTON – A Louisiana man is seeking damages from a California business and its driver over a collision on an interstate in Fort Bend County.
Joshua Dauzart filed a complaint on Sept. 6 in the Houston Division of the Southern District of Texas against the El Recodo Enterprises LLC and Carlos Ivan Jarmillo Zamora alleging negligence.
According to the complaint, the plaintiff alleges that on Nov. 2, 2016, he was traveling in the left lane of Interstate 69 in Rosenberg when defendant Zamora changed lanes and caused the commercial motor vehicle owned by defendant El Recodo to strike the plaintiff's vehicle, forcing it into the guardrail. He alleges he sustained severe bodily injuries to his cervical and lumbar spine and sustained damages greater than $75,000 as a result of the collision.
The plaintiff holds El Recodo Enterprises LLC and Zamora responsible because defendant Zamora allegedly failed to yield the right of way, failed to keep a proper lookout and negligently changed lanes when it was not safe to do so.
The plaintiff requests a trial by jury and seeks all damages, pre- and post-judgment interest, costs and such other and further relief to which he may be lawfully entitled. He is represented by Scott P. Callahan of Law Office of Scott P. Callahan PC in Houston.
