Lender alleges checks written by Xxcell Freight Systems were denied due to insufficient funds

HOUSTON – A Texas corporation is alleged to have written checks to repay a Harris County lender that were dishonored for insufficient funds.

Mahedi Maknojia filed a complaint on Sept. 4 in the Harris County District Court against Xxcell Freight Systems Inc., et al. alleging breach of contract and other counts.

According to the complaint, the plaintiff alleges that he loaned certain amounts to defendants in order to assist them to meet their payroll and to recover regular business expenses. The suit states the checks the defendants wrote to the plaintiff were dishonored for insufficient funds.

The plaintiff alleges damages in the sums of $3,337,463.30 and $251,290 relating to the dishonored checks.

The plaintiff seeks monetary relief of more than $1 million and all other relief to which the plaintiff is entitled. The plaintiff is represented by Joseph F. Calvin Jr. of Hughes Watters Askanase LLP in Houston.
