Georgios sales associate alleges he was paid straight time rate for overtime work

HOUSTON – A Harris County man alleges that his hours were reduced by his clothing store employer because of his complaints about not being paid the appropriate rate for overtime work.

Stephan Handy, individually and on behalf of all others similarly situated, filed a complaint on Sept. 11 in the Houston Division of the Southern District of Texas against Georgios of Greenspoint Mall Inc., Georgios of Sharpstown Center Inc. and Eman Srour alleging violation the Fair Labor Standards Act.

According to the complaint, the plaintiff currently works for the defendants as a sales associate and has been employed by them since February 2014. He alleges the defendants pay the same rate for overtime hours worked as for straight time. He alleges in August, he complained about the nonpayment of overtime to the defendants and his hours were reduced.

The plaintiff holds Georgios of Greenspoint Mall Inc., Georgios of Sharpstown Center Inc. and Srour responsible because the defendants allegedly failed to pay for overtime work at a rate of time-and-one-half and retaliated against him for his complaints.

The plaintiff requests a trial by jury and seeks unpaid overtime compensation, liquidated damages, compensatory and punitive damages, attorney’s fees, costs, expenses and such other and further relief to which plaintiff and class members may be entitled.
