GALVESTON – An oil and gas exploration and production company is alleged to have misclassified workers as independent contractors and failed to pay them overtime.
Todd Grice, individually and on behalf of all others similarly situated, filed a complaint on Sept. 11 in the Galveston Division of the Southern District of Texas against Range Resources Corp. alleging violation of the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that he regularly worked more than 40 hours each week for the defendant as a day-rate independent contractor. He alleges he did not receive overtime for all hours worked in excess of 40 hours in a single workweek.
The plaintiff holds Range Resources Corp. responsible because the defendant allegedly improperly classified plaintiff and those similarly situated as independent contractors and paid them a daily rate with no overtime compensation.
The plaintiff requests a trial by jury and seeks an order designating the potential putative FLSA class as a collective action, and award for unpaid back wages due, liquidated damages, attorneys’ fees, costs and interest and such other and further relief as may be necessary and appropriate.
