HOUSTON – A business in Harris County is alleged to have failed to deliver equipment purchased by a buyer.
Leonardo F. Espino Portillo filed a complaint on Sept. 12 in the Harris County District Court against Equip-Texas Inc. alleging conversion, unjust enrichment and other counts.
According to the complaint, the plaintiff alleges that on June 7, he defendant sold to plaintiff Caterpillar equipment for $63,750, which was paid by plaintiff through wire transfer on June 10. The suit states the defendant agreed to deliver the equipment to the plaintiff but did not deliver it.
The plaintiff holds Equip-Texas Inc. responsible because the defendant allegedly failed and refused to deliver said equipment and to return plaintiff's money.
The plaintiff seeks damages in an amount of at least $63,750, plus interest, costs, attorney's fees and such other and further relief to which he is justly entitled. He is represented by Celestine C. Ude of Law Office of Celestine Ude in Houston.
