HOUSTON – A Harris County consumer alleges a New York-based debt collector contacted his boss about an alleged debt.
Dennis Rohloff filed a complaint on Sept. 13 in the Houston Division of the Southern District of Texas against Clarion Recovery Service LLC, et al. alleging that they violated the Fair Debt Collection Practices Act and the Texas Finance Code.
According to the complaint, the plaintiff alleges that at some time in the past, plaintiff incurred a financial obligation that went into default before it was purchased by defendants for collection. He alleges he disputes the amount the defendants are attempting to collect and that the defendants used false, deceptive and misleading statements to collect the alleged debt. The suit also states that the defendant contacted his boss about the alleged debt.
The plaintiff holds Clarion Recovery Service LLC, et al. responsible because the defendants allegedly left message to his boss about his account and threatened to file a lawsuit without ever intending to do so.
The plaintiff requests a trial by jury and seeks actual and statutory damages, attorneys' fees and costs and such other and further relief as the court deems just and proper. He is represented by Jeffrey D. Wood of The Wood Firm PLLC in Little Rock, Arkansas.
