GALVESTON – The City of Texas City faces legal action over what a local man asserts was excessive force applied by two of its police officers, according to recent Galveston federal court records.

Brian Miller filed a lawsuit against Texas City, Police Sgt. B. Macik, and patrolman R. Dricks on Sept. 20. The suit claims Macik and Dricks physically attacked Miller after arresting him in his father’s driveway on Oct. 8, 2017.

Dricks is accused of hitting the complainant in the head “three times with the butt of a pistol” while Dricks is believed to have used a Taser on him while he was still laying on the ground.

Miller states that he suffered a broken jaw and a concussion because of the subject incident.

Consequently, he seeks unspecified monetary damages and a jury trial.

Randall L. Kallinen of Kallinen Law PLLC in Houston is representing the plaintiff.
