Sam's Club shopper alleges rug in cart caused her to trip

HOUSTON – A Harris County woman alleges she was injured while shopping at a warehouse store because of the way an employee placed a rug in her cart.

Gladys M. Prejean filed a complaint on Sept. 20 in the Harris County District Court against Sam's East Inc. alleging negligence.

According to the complaint, the plaintiff alleges that on June 16, 2017, she was shopping at defendant's Sam's Club Store No. 8281 in Houston when she tripped over a rug that was improperly placed by defendant's employee in the bottom of the cart she was using. 

The plaintiff holds Sam's East Inc. responsible because the defendant's employee negligently placed the rug in such as position so that it stuck out of the cart, creating a trip hazard.

The plaintiff seeks damages in a sum to be determined by the trier of fact and award for costs, fees and interest and such other and further relief to which she may be entitled. She is represented by David K. Mestemaker, Norman L. Straub, Jonathan B. Zumwalt and Codi D. Kraus of Mestemaker & Straub in Houston.
