Zodiac Seats employee seeks damages over allegedly hostile treatment because of race

SHERMAN – A Denton County man of Nigerian descent alleges he was retaliated against after filing complaints with his employer's human resources department regarding discriminatory treatment.

Joseph Asagba filed a complaint on Sept. 21 in the Sherman District of the Eastern District of Texas against Zodiac Seats LLC alleging that the employer violated Title VII of the Civil Rights Act and other counts.

According to the complaint, the plaintiff began working for the defendant in February 2014 at its Gainesville facility as an arm builder. He alleges throughout his employment, he has been subjected to racially hostile comments, hostile work environment and retaliation. He alleges he reported the treatment to human resources and was retaliated against with harassment and unwarranted discipline.

The plaintiff holds Zodiac Seats LLC responsible because the defendant allegedly engaged in discrimination with the respect of the terms and conditions of his employment.

The plaintiff requests a trial by jury and seeks all damages, attorney's fees, costs and disbursements, and such other and further legal and equitable relief as may be found appropriate. He is represented by Jay D. Ellwanger and Esha Rajendran of Ellwanger Law LLLP in Austin.
