HOUSTON – The buyers of a Houston property allege it will cost $80,000 to remove and replace tile that was incorrectly installed.
Wayne O. Whitney and Susan S. Whitney filed a complaint on Sept. 26 in the Harris County District Court against Silverwood Builders I Inc. alleging violation of the Texas Deceptive Trade Practices-Consumer Protection Act and other counts.
According to the complaint, the plaintiffs contracted with the defendant in May 2016 to purchase a partially completed home in Houston for more than $4 million.
The suit states the plaintiffs closed on the property in September 2016 and a year later, the plaintiffs discovered that the patio and summer kitchen tiles were incorrectly and improperly installed. They allege the cost to remove and replace the tile is $80,000.
The plaintiffs hold Silverwood Builders Inc. responsible because the defendant allegedly did not make an offer of settlement under DTPA or offered to cure the construction defect.
The plaintiffs seek monetary relief of more than $200,000 but less than $1 million and such other and further relief to which plaintiffs may be justly entitled. They are represented by Sarahjane "SJ" Davidson Swanson of Swanson Law Firm PLLC in Houston.
