Tenants allege TexasRenters.com, landlord failed to return security deposit

GALVESTON – Two former tenants of a League City property allege their security deposit was not refunded within 30 days of the date of surrender as required by state law.

Matthew Yarbrough and Sera Yarbrough filed a complaint on Sept. 27 in the Galveston County District Court against Daniel Milbry and TexasRenters.com alleging breach of contract.

According to the complaint, the plaintiffs allege that on May 5, they provided defendants with a notice of their intent to terminate the lease and to vacate a League City premises on or before June 30. As of the filing of this complaint, the plaintiffs allege they have not received a refund of their security deposit. 

The plaintiffs hold Milbry and TexasRenters.com responsible because the defendants allegedly failed to provide an itemized list of deductions or refund plaintiffs' security deposit within 30 days from date of surrender as required by Texas Landlord Tenant Law.

The plaintiffs request a trial by jury and seek actual damages in an amount as the evidence may show, with interest, costs and all other and further relief to which they may be entitled. They are represented by Cris A. Rasco of Rasco Law Firm in Texas City.
