Texas Windstorm Insurance sued for allegedly underpaying damages after Hurricane Harvey

BEAUMONT — A homeowner is suing Texas Windstorm Insurance Association, alleging breach of insurance contract.

Luis Lopez filed a complaint on Sept. 19, in the Jefferson County District Court, against Texas Windstorm Insurance Association alleging that the licensed insurer failed to recognize full coverage of the insured.

The plaintiff alleges that in August 2017, his insured house and other property was damaged due to Hurricane Harvey. He subsequently filed a claim for his loss under the insurance policy provided by defendant. 

The plaintiff holds Texas Windstorm Insurance Association responsible because the defendant allegedly failed to include all damages and undervalued damages during inspection.

The plaintiff requests a trial by jury and seeks all damages that may be established by evidence, with interest, attorney's fees, costs and such other and further relief to which he may be entitled.
