Preschool sued for fingernail clipping mishap of minor, loss of earning capacity damages sought

BEAUMONT – The guardian of a minor who attended Niklem Kids Academy is suing the preschool for a fingernail clipping injury the little girl suffered last April.

Individually and on behalf of minor Faith Hayes, Shaminika Hayes filed her suit Sept. 25 in Jefferson County District Court, seeking, among other things, loss of earning capacity damages.

According to the lawsuit, on April 13, 2017, Faith was under the care of Niklem Kids Academy when the owner’s minor daughter attempted to clip her “fingernails and cut her fingers.”

Shaminika alleges the preschool was negligent in allowing a child to clip Faith’s fingernail.

On top of loss of earning capacity damages, Shaminika accuses the preschool of gross negligence, entitling her to recover punitive and exemplary damages.

Shaminika is also suing for the minor’s pain, mental anguish, impairment and medical expenses.

She is represented by Tom Oxford, attorney for the Waldman Smallwood law firm in Beaumont.

Judge Kent Walston, 58th District Court, is assigned to the case.
