Montgomery County man alleges property seller failed to clean it as promised

GALVESTON – A Montgomery County man alleges a Galveston County man failed to clean a property as agreed and now owes $5,000.

Tom Kubala filed a complaint on Oct. 8 in the Galveston County District Court against Albert Troy Ybarra alleging breach of contract.

According to the complaint, the plaintiff alleges that in 2018, he purchased defendant's property with an agreement that defendant would clean the same by June 1. The suit states the agreement states that if the cleaning was not done by that date, the defendant agreed to pay $5,000 to plaintiff.

The plaintiff holds Ybarra responsible because the defendant allegedly never did the work he promised to do and did not pay plaintiff the $5,000 he owes.

The plaintiff seeks monetary relief of less than $100,000 and such other just and proper relief. He is represented by Samuel D. Davis of The Law Office of Samuel D. Davis PLLC in Houston.
