Mother sues Texas Children's Hospital for defamation, refutes claims of 'medical child abuse' against daughter

HOUSTON – A local woman has brought a defamation lawsuit against Texas Children’s Hospital, claiming the defendant made false statements resulting in Harris County Child Protective Services taking her daughter away.

In court papers filed on Oct. 9 in the Harris County 80th District Court, Ajshay James refutes the hospital’s allegations that she committed “medical child abuse” against the 3-year-old child.

James asserts that the statements additionally inflicted “personal and economic” injuries upon her. She is reportedly prevented from seeing her daughter “except under supervision and for only an hour per week.”

Consequently, the plaintiff seeks $1 million in damages and a jury trial.

She is represented by Harold V. Dutton, Jr. of the Dutton Law Firm in Houston.
