Worker seeks damages from DivisionOne Construction after allegedly injuring knee at job site

HOUSTON – A Harris County man alleges he was injured at an elementary school job site by a boom lift because of an unsafe working environment.

Jose Cordova filed a complaint on Oct. 11 in the Harris County District Court against DivisionOne Construction LLC alleging negligent exposure to unsafe working conditions and premises defect.

According to the complaint, the plaintiff alleges that on Feb. 14, he hit his knee on the metal part of a boom lift while working for a subcontractor at the Wharton Elementary construction site in Houston, which was controlled by the defendant. He alleges he suffered several serious and incapacitating injuries to the body as a result. 

The plaintiff holds DivisionOne Construction LLC responsible because the defendant allegedly knew or should have known that the job-made pathway used by the boom lift at the job site was not constructed or secured in a manner to make it safe for heavy machinery.

The plaintiff requests a trial by jury and seeks monetary relief of more than $200,000 but less than $1 million and all further relief to which he is justly entitled. He is represented by Carlos A. Leon, Piero A. Garcia and Sofia M. Straus of The Leon Law Firm PC in Sugar Land.
