Patient sues dentist for wrongfully placing him in braces

HOUSTON – A Baytown man has brought a medical malpractice lawsuit against his dentist and her practice.

Recent Harris County District Court records show that Jose Herrera filed the suit against Dr. Hoang Dinh and Shine Dental in the 281st District Court on Oct. 15. Herrera alleges that the defendants wrongfully placed him in braces when he was supposed to undergo orthognathic surgery to correct his significant skeletal discrepancy when he turned 18 years of age.

The braces will cause the plaintiff, who was born on Jan. 29, 2000, to lose his upper teeth and be dependent on implants and crowns, court papers say.

The defendants also purportedly did not perform progress radiographs to “monitor treatment and in particular root resorption.”

Consequently, Herrera seeks unspecified monetary damages.
