HOUSTON – A seaman alleges he injured his back while working on a dredge and a company failed to pay or delayed paying benefits.

Joel A. Perez filed a complaint on Oct. 15 in the Harris County District Court against Orion Marine Construction Inc. alleging negligence.

According to the complaint, the plaintiff alleges that on Oct. 9, he was performing his regular duties when he seriously injured his back while pulling on a derrick cable. He alleges he has suffered physical pain, mental anguish, lost wages and medical expenses and with reasonable probability, that will continue for the rest of his life.

The plaintiff holds Orion Marine Construction Inc. responsible because the defendant allegedly has denied payment and unreasonably delayed payments for maintenance and cure benefits.

The plaintiff requests a trial by jury and seeks actual and exemplary damages, plus interest, costs and all other relief to which he is entitled. He is represented by Anthony G. Buzbee and Christopher J. Leavitt of The Buzbee Law Firm in Houston.
