Worker's fatal fall in cargo tank results in litigation

HOUSTON – The family of a man who perished almost two years ago from injuries allegedly sustained in a fall in a cargo tank have brought a lawsuit against his employers, recent Harris County District Court records show.

The law firm Mestemaker & Straub in Houston filed the suit on behalf of the late Fernando Rodriguez Garcia’s immediate kin against Express Container Services of Houston, LLC; Equipment Care Center of Houston, LLC; and Jesse Lara on Oct. 23 in the 295th District Court.

According to court filings, the decedent was “not feeling well and pale” when the defendants put him to work cleaning cargo containers on Nov. 17, 2016. The respondents failed to properly manage or supervise Garcia, the original petition says.

Consequently, his survivors seek unspecified monetary damages.
