Jones Act seaman alleges slippery deck caused fall, seeks $100,000 from employer

BEAUMONT – A Port Arthur seaman alleges a slippery deck caused him to injure his right side while working.

Xuan Tranh Nguyen filed a complaint on Oct. 11 in the Jefferson County District Court against Elizabeth Nguyen alleging negligence and citing the Jones Act.

According to the complaint, the plaintiff alleges that on Oct. 20, 2016, he was employed by the defendant working aboard the marine vessel the St. Michael as a crew member when he lost his footing and fell on a slick substance on the deck. He alleges he injured his right side, back and shoulder in the fall.

The plaintiff holds Elizabeth Nguyen responsible because the defendant allegedly failed to maintain the vessel's dock with non-skid material and failed to maintain a safe place to work.

The plaintiff seeks monetary relief between $100,000 and $200,000 and such other and further relief to which he may be entitled. He is represented by Cristobal M. Galindo of Cristobal M. Galindo PC in Houston.
