Apache Corp. alleged to have terminated employee in retaliation over FMLA leave

HOUSTON – A former employee of a Houston corporation alleges he was retaliated against for requesting medical leave.

Brian Mahn filed a complaint on Oct. 24 in the Houston Division of the Southern District of Texas against Apache Corp. alleging that the Delaware corporation violated the Family and Medical Leave Act.

According to the complaint, the plaintiff began working for the defendant in 2014. He alleges that in May 2017, he began suffering from a flare up of narcolepsy and began having difficulty reaching full awakeness in the mornings. The suit states he was granted an adjusted schedule to accommodate his disability at first. On May 9, the suit states he was terminated from his employment. 

The plaintiff alleges he asked about FMLA leave and the defendant discouraged and denied it.

The plaintiff holds Apache Corp. responsible because the defendant allegedly discouraged him from taking intermittent medical leave and retaliated against him by terminating his employment for requesting medical leave.

The plaintiff requests a trial by jury and seeks actual and general damages, with interest, liquidated damages, attorneys’ fees, costs and such other and further relief to which he may be justly entitled.
