Injured driver seeks declaration regarding alleged AAA Texas policy limit offer

HOUSTON – An injured driver is suing an insurance company after it allegedly offered to settle a claim and then revoked it.

Chimaobi Ukachukwu filed a complaint on Oct. 25 in the Harris County District Court against AAA Texas LLC and Marilyn Lewis seeking declaratory relief.

According to the complaint, on Feb. 13, the plaintiff was injured in an auto accident involving AAA Texas' insured Scott Boyd. On June 22, the plaintiff alleges defendant Lewis accepted plaintiff's demand for the policy limits, but then later that day another representative stated the offer was made in error.

The plaintiff seeks a declaration requiring the defendant to pay policy limits in exchange for a release of claims, attorney's fees and all other relief to which the plaintiff is entitled. The plaintiff is represented by Husein Hadi, Jamil Thomas, Carnegie H. Mims III and Sedrick Stagg of The Hadi Law Firm PLLC in Houston.
