HOUSTON – An employee of a Houston residential and commercial construction company alleges he was paid his straight time rate for overtime hours worked.

Ramses Medina, individually and on behalf of all others similarly situated, filed a complaint on Oct. 29 in the Houston Division of the Southern District of Texas against Cagle Stucco & Masonry LLC alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff has been employed by the defendant since February. He alleges that he regularly worked more than 40 hours per week and was paid the same hourly wage rate regardless of the number of hours worked.

The plaintiff holds Cagle Stucco & Masonry LLC responsible because the defendant allegedly failed to pay for overtime work at a rate of time-and-one-half employees' regular wage rate and failed to maintain accurate time and pay records.

The plaintiff requests a trial by jury and seeks an order allowing this action to proceed as a collective action, award for all unpaid overtime compensation, liquidated damages, attorneys’ fees, costs, interest and such other and further relief to which plaintiff and the other laborers may show themselves to be justly entitled. He is represented by Melissa Moore, Curt Hesse and Bridget Davidson of Moore & Associates in Houston.
