BEAUMONT – The surviving heirs of a woman who died in 2016 are seeking damages from the city of Beaumont and others over the medical care she received.

India Zeno, individually and as personal representative of the estate of Delana Lashel Kittling, et al. filed a complaint on Oct. 24 in the Jefferson County District Court against the city of Beaumont, Baptist Hospital of Southeast Texas, et al. alleging negligence.

According to the complaint, the plaintiffs allege that on Aug. 13, 2016, plaintiffs' decedent, Delana Lashel Kittling, was experiencing shortness of breath when family member called 911. The suit states emergency medical technicians arrived within 5 minutes and transported her to Baptist Hospital's Beaumont campus, where she later died the same day.

The plaintiffs hold the city of Beaumont, Baptist Hospital of Southeast Texas, et al. responsible because the city of Beaumont's personnel allegedly failed to avoid causing a midtracheal tear while inserting endotracheal tube (ETT) in Kittling and failed to report the tear in the trachea and the improper placement of the ETT to the emergency medicine physician or nursing staff.

The plaintiffs seek damages in excess of the minimum jurisdictional limits of the court, interest, costs and such other and further relief to which they are entitled. They are represented by Kevin A. Murray of Kevin Murray in Houston.
