SHERMAN – A Minnesota resident alleges a Carrollton collection agency did not mark an alleged debt as disputed.
Hussein Mohamud filed a complaint on Nov. 5 in the Sherman District of the Eastern District of Texas against Southwest Credit Systems LP alleging that the debt collector violated the Fair Debt Collection Practices Act.
According to the complaint, an alleged debt owed by the plaintiff to Comcast was assigned to the defendant for collection. The plaintiff claimss that on March 10, the defendant sent a collection letter to plaintiff and he disputed the alleged debt April 9. The plaintiff alleges the defendant failed to respond to the dispute and is still attempting to collect the alleged debt. He also alleges the alleged debt was not marked as disputed on his credit report.
The plaintiff holds Southwest Credit Systems LP responsible because the defendant allegedly continued collection efforts even though the alleged debt had not been verified.
The plaintiff requests a trial by jury and seeks actual damages, statutory damages of $1,000, litigation costs, attorney’s fees and such other and further relief as may be just and proper. He is represented by Jody B. Burton of Lemberg Law LLC in Wilton, Connecticut.
