Client alleges The Accent Group refused to pay for severed cable line

GALVESTON – A property owner is seeking damages from a landscaping company after it allegedly severed a buried cable line.

Richard Warneke filed a complaint on Nov. 1 in the Galveston County District Court against Nathalie McKean, doing business as The Accent Group, alleging material breach of agreement.

According to the complaint, the plaintiff contracted the defendant for landscaping work at his Galveston County property. He alleges on May 14, prior to the start of the project, he informed the defendant that cable lines had recently been buried in his yard. He alleges the defendant severed a cable line.

On July 11, the suit states the plaintiff received a demand letter from AT&T Risk Management requesting payment of $1,208.47 within 30 days for said damages. He alleges he attempted to contact the defendant regarding the damage claim and did not receive a response.

The plaintiff holds McKean responsible because the defendant allegedly refused to pay for the severed cable line.

The plaintiff requests a trial by jury and seeks monetary relief of $100,000 or less. He is represented by Joseph D. Terry and L. Lee Thweatt of Terry & Thweatt PC in Houston.
