Motorcyclist seeks more than $200,000 from Arch-Con, others over accident

HOUSTON – A Navarro County man alleges he was thrown from his motorcycle after driving over sand and soil on a road carried from a construction site.

David Hunnicutt filed a complaint on Nov. 5 in the Harris County District Court against Arch-Con Corp., et al. alleging negligence.

According to the complaint, the plaintiff alleges that on Nov. 5, 2016, he was traveling on Valley Ranch Parkway in New Caney near a commercial establishment under construction by the defendants when he drove over a large amount of sand and soil on the road, causing him to be thrown from his motorcycle. He alleges he sustained serious bodily injuries that resulted in medical expenses, pain and suffering, disfigurement and lost wages. 

The plaintiff holds Arch-Con Corp., et al. responsible because the defendants allegedly failed to prevent dangerous condition from developing and failed to correct or warn of it.

The plaintiff requests a trial by jury and seeks monetary relief of more than $200,000 but less than $1 million and such other and further relief to which he may be justly entitled. He is represented by Robert Morse and Benjamin C. Kennedy of Daspit Law Firm in Houston.
