Court papers assert subdivision's development in low-lying area enabled flooding from Harvey

HOUSTON – Four Sugar Land residents have pursued legal action in response to Hurricane Harvey-related flooding to their master planned community, recent Harris County District Court records show.

In a lawsuit filed on Nov. 13 in the Harris County 165th District Court, Tanya Valli, Anthony Valli, David Schwager, and Allison Schwager allege that The Johnson Development Corp.; Riverstone Homeowners Association, Inc.; and Levee Management Services, LLC failed to disclose to them that their homes in the Riverstone subdivision bore an “extreme risk of flooding.”

Johnson Development purportedly developed Riverstone in an area “originally designated as a flood zone and planned for recreational use” and “removed it from a flood plain despite (its) knowledge of the low elevation and considerable flood risk.”

LMS is faulted for “deliberately diverting flood waters into particular sections of the community.”

According to the plaintiffs, they have been displaced because of the defendants’ actions.

Consequently, they seek unspecified monetary damages.

The law firm Spagnoletti & Co. in Houston is representing the complainants.
