Property owners allege CC Telge Road's repurchase right has passed

HOUSTON – The buyers of a Tomball property allege that the developer seller is unlawfully attempting to repurchase it.

Brett Chance and Jessica Chance filed a complaint on Nov. 12 in the Harris County District Court against CC Telge Road LP seeking declaratory judgment.

According to the complaint, on July 1, 2016, the plaintiffs purchased a property from Mario and Nora Gonzales for $187,000. Since then, no construction has been commenced because they believed that defendant's right to repurchase the property had expired, the suit states.

The suit states in August, the plaintiffs received a notice from the defendant that it intended to exercise its repurchase right. The plaintiffs allege the time to repurchase has passed and is no longer applicable.

The plaintiffs seek an order declaring that defendant's repurchase right is unconscionable, award for attorney's fees, costs and such other and further relief to which they are entitled. They are represented by Jason D. Kraus of The Kraus Law Firm in Houston.
