McDonald's patron seeks more than $100,000 after falling in restroom

HOUSTON – A woman alleges she was injured at a fast food restaurant because of a wet floor in the restroom.

Shanta Trahan Simeon filed a complaint on Nov. 15 in the Harris County District Court against Kelly Kenswick LP, doing business as McDonald's, alleging negligence and premises liability.

According to the complaint, on Dec. 4, 2016, the plaintiff was injured when she fell on a wet floor in the restroom at defendant's McDonalds franchise in Humble. She alleges she sustained injuries and was caused to suffer pain and suffering, mental anguish, medical expenses and disfigurement. 

The plaintiff holds Kelly Kenswick LP responsible because the defendant allegedly failed to provide adequate warning signs or barriers to prevent its customers from falling and failed and refused to compensate her for her injuries.

The plaintiff seeks monetary relief of more than $100,000 but less than $200,000. She is represented by Nicola Drake of The Drake Law Firm PC in Houston.
