Truck driver alleges CKJ Trucking failed to provide reasonable accomodation

SHERMAN – A Grayson County man alleges he was terminated from his job as a truck driver because of a disability.

David W. Spindle filed a complaint on Nov. 16 in the Sherman District of the Eastern District of Texas against CKJ Trucking LP alleging that the former employer violated the Americans with Disabilities Act.

According to the complaint, the plaintiff was employed by the defendant as a truck driver for three years. The suit states in April 2017, he was approved for leave under the Family and Medical Leave Act for an on-the-job injury that required a partial amputation of the great toe on his right foot. He alleges he fully recovered and returned to work a month later.

The suit states the plaintiff took FMLA leave again in 2017 because of chest pain and returned to work Dec. 19, 2017. He alleges he was discharged shortly afterward.

The plaintiff holds CKJ Trucking LP responsible because the defendant allegedly failed to provide reasonable accommodation, failed to engage in any interactive process and terminated his employment on the basis of his disability or perceived disability.

The plaintiff requests a trial by jury and seeks reinstatement, actual and punitive damages, attorney’s fees, costs and interest and all other relief to which he may show himself justly entitled. He is represented by Ronald R. Huff of Ronald R. Huff Attorney and Counselor at Law in Sherman.
