Man falls into 'gaping' hole in pavement, sues City of Houston

HOUSTON – A Harris County man is suing the City of Houston after he allegedly stepped into what he describes was a “gaping” hole in the pavement.

Joshua Marks’s lawsuit, which was filed on Nov. 20 in the Harris County 152nd District Court, says the incident occurred on last Apr. 19 when Marks and his wife were walking home to their apartment.

The plaintiff estimates the hole to be “between four and five feet deep” and claims the city failed to fill it up after excavating a pipe. He reportedly suffered injuries to his lower back, left leg, right hand, and general body.

Consequently, Marks seeks unspecified monetary damages and a jury trial.

He is represented by Kenneth R. Baird of The Baird Law Firm in Houston.
