Worker seeks $1 million from James J. Flanagan Shipping, others over fall

BEAUMONT – A Jefferson County man is seeking $1 million after falling from a metal basket lifted by a forklift.

Kevin Andrus filed a complaint on Oct. 29 in the Jefferson County District Court against James J. Flanagan Shipping Corp., et al. alleging negligence and other counts.

According to the complaint, the plaintiff alleges that on Sept. 14, he was working as un-hooker for P.C. Pfeiffer Co. when the welded angle iron of the metal basket carrying him broke, causing him to fall 8 to 10 feet to the ground. The suit states the basket was lifted by a forklift owned and operated by James J. Flanagan Shipping.

The plaintiff alleges he suffered a broken right heel and severe ankle sprain as a result of the fall. 

The plaintiff holds James J. Flanagan Shipping Corp., et al. responsible because the defendants allegedly failed to properly design and manufacture the metal basket and failed to adequately inspect and test the same.

The plaintiff seeks monetary relief of more than $1 million and all other relief as may be deemed appropriate. He is represented by Muhammad S. Aziz of Abraham, Watkins, Nichols, Sorrels, Agosto & Aziz in Houston and Allena J. Wright of Law Office of Allena J. Wright in Houston.
