Assisted living facility responsible for employee's slip and fall, suit says

GALVESTON – An assisted living facility is the target of a personal injury state injury lawsuit from one of its employees, recent Galveston County District Court records.

In court papers filed against Summerville at Friendswood Associates, L.P., doing business as Brookdale Friendswood, on Nov. 20 in the Galveston County 10th District Court, Delfina Gutierrez claims that she slipped and fell on Dec. 7, 2016 while “bathing a non-ambulatory/non-weight bearing resident.”

Employed as a resident assistant, Gutierrez attributes the subject incident to the resident falling as a result of “the slippery surface of the shower.”

“In an attempt to catch the patient’s fall, the plaintiff Gutierrez also slipped in a forward-splits fashion,” the suit says.

The defendant allegedly failed to heed “several complaints and requests for mats or anti-slip surfaces” prior Gutierrez’s and the resident’s slip and fall.

Consequently, the plaintiff seeks unspecified monetary damages.

She is represented by the law firm Abraham, Watkins, Nichols, Sorrels, Agosto & Aziz in Houston.
