HOUSTON – A Montgomery County man alleges he was injured while walking to a work meeting because of pieces of used rail on the ground.
Johnny Thomas filed a complaint on Nov. 27 in the Harris County District Court against Union Pacific Corp. citing the Federal Employers' Liability Act.
According to the complaint, the plaintiff alleges that on July 30, 2017, he was in the course and scope of his employment with the defendant and he was injured when he tripped on a piece of used rail lying on the ground at the JFK Junction Yard in Dallas. He alleges he suffered injuries to his right shoulder, right knee and other parts of his body as a result.
The plaintiff holds Union Pacific Corp. responsible because the defendant allegedly failed to provide a safe path to the meeting area and negligently placed pieces of rails on the ground.
The plaintiff requests a trial by jury and seeks monetary relief of more than $1 million and all other relief that is appropriate. He is represented by Christopher K. Johns of Lapeze & Johns PLLC in Houston.
