BEAUMONT – The Ill.-based Sulaiman Law Group, Ltd. has filed a lawsuit on behalf of a man who alleges that a law firm in San Angelo unlawfully attempted to collect a debt from him, recent Beaumont federal court records show.
In court documents filed on Dec. 6, Robert J. Giordano explains that the Darby Law Firm, PLLC sent him a written notice in an attempt to collect on a personal loan he took out prior to this year.
According to the original petition, Darby failed to disclose that it was a debt collector.
Giordano says that he “was concerned about the potential ramifications of receiving such an unclear letter.”
“Since the letter was from a law firm, the plaintiff was concerned that he was being contacted by an entity preparing to sue him, since there was no disclosure that the letter was from a debt collector,” the suit says.
The inadequacy in question prompted the plaintiff to consult with legal counsel.
Giordano further asserts that the defendant “unduly inconvenienced and harassed” him, claiming he suffered from emotional distress and mental anguish because of the ordeal.
Consequently, the complainant seeks unspecified monetary damages and a jury trial.
