HOUSTON – A limited liability company alleges that it paid a company to pay a supplier for materials and it failed to do so.
South Heights Purchase LLC filed a complaint on Dec. 4 in the Harris County District Court against SG Blocks Inc. et al. alleging construction trust fund violation, breach of contract and other counts.
According to the complaint, the plaintiff alleges that on June 9, 2017, the parties entered into a contract for the construction of a parking facility in Houston for $81,276.
The suit states SG Blocks agreed in exchange for payment, it would procure shipping containers from Caru Containers. The plaintiff alleges the defendant failed to tender the funds to Caru and as a result, Caru will not release or deliver the containers.
The plaintiff holds SG Blocks Inc. et al. responsible because the defendants allegedly defaulted under the agreement by failing to pay its supplier.
The plaintiff seeks judgment against defendants in the amount of $81,276, with interest, costs and such other general and specific relief. It is represented by Lisa M. Norman of Andrews Myers PC in Houston.
